DateMuse (the “Service”) is owned and operated by Fabiola M. Alfaro Larios, trading as DateMuse (“we”, “us”), a sole proprietor. Customer inquiries and legal notices can be sent to info.datemuse@gmail.com.

When you create an account or make a purchase, you are entering into a contract with Fabiola M. Alfaro Larios — not with our payment provider, and not with any venue listed in the Service.

By creating an account, accessing, or continuing to use DateMuse, you confirm that you have read these Terms & Conditions and agree to them. If you do not agree, please stop using the Service. We will tell you about material changes by posting the updated terms here and, where the change matters to your account, by emailing you.

DateMuse is a date-planning assistant. It suggests date ideas, builds itineraries from the preferences you give us, lets you save favorites, schedule dates on a calendar, keep photos and short videos of the dates you have been on, and share a single date with someone you invite.

DateMuse is not a dating service, a matchmaking service, or a social network. It does not introduce you to other members, does not match you with anyone, and does not vet or endorse the venues it lists.

You must be at least 18 years old, and if you are using DateMuse on behalf of an organisation, you must have authority to bind that organisation to these terms.

• Give us your real email address and keep your account details up to date.
• Keep your password private. You are responsible for activity that happens under your account, so tell us straight away at info.datemuse@gmail.com if you think someone else has access.
• One account per person. Date plans, saved places and photos are private to the account that created them.

DateMuse is offered on a free plan and a paid Premium plan, plus optional one-time purchases:

• Free — date ideas, saving favorites, planning and scheduling, and up to 3 AI-generated itineraries per calendar month.
• Premium, monthly — US$9.99 per month.
• Premium, yearly — US$79.99 per year.
• One-time itinerary — US$2.99 for a single AI itinerary purchase, with no recurring charge.

Prices are shown in US dollars and exclude sales tax, VAT or GST, which are added at checkout where the law requires it. Premium renews automatically at the same price until you cancel. You can cancel a subscription at any time from the billing page; you keep Premium features until the end of the period you have already paid for. We may introduce new plans or change prices for new customers — if we raise the price of a plan you are subscribed to, we will tell you before the increase applies to you.

Payments are processed securely by Stripe. For some orders, Stripe’s Link service may act as the reseller and handle tax, receipts and payment support; your card statement may then show “LINK.COM*”. Our refund commitments are set out in our Refund Policy.

Payments are processed by Stripe, Inc. Where Stripe or its Link service acts as reseller for an order, it is responsible for calculating and remitting tax and for payment-related support on that order. For anything else about your order, contact us and we will help.

DateMuse is for planning your own dates. You agree not to:

• Use the Service for anything unlawful, or to plan or encourage harm to another person.
• Commit fraud or abuse the purchase flows, including stolen payment cards or chargeback abuse.
• Send spam, scrape or bulk-download date ideas, venue data or other members’ content, or resell, redistribute or white-label the Service.
• Infringe anyone’s intellectual property, or upload photos or videos you have no right to share.
• Interfere with the Service’s security — malware, probing or scanning for vulnerabilities, attempts to bypass access limits or the free-tier quota, or unauthorized access to another account.
• Reverse engineer the Service, or use it to train an AI model or build a competing product.
• Use DateMuse to stalk, harass, surveil or track another person, including someone you have invited to share a date.

Parts of DateMuse are generated by AI. Itineraries, mood-based plans and suggestions are machine-made drafts, created from the preferences you enter and the date ideas in our library.

• You are responsible for the prompts and preferences you enter, for how you use what comes back, and for checking that the result is suitable and accurate before you rely on it.
• Accuracy — AI output can be incomplete, out of date or plainly wrong. Opening hours, prices, availability and travel times must be confirmed with the venue. An itinerary is a starting point, not a booking or a promise that a place exists or will be open.
• Not professional advice — output is not legal, financial, medical, dietary or safety advice, and is not a substitute for a qualified professional where your situation calls for one.
• Rights to your input — you keep the rights you already hold in the text, photos and videos you upload, and you confirm you have the right to share them.
• Output ownership — to the extent we hold any rights in generated text shown to you, we assign those to you, subject to these terms and to your acceptable-use obligations.
• Prohibited AI use — do not use the AI features to produce illegal content, sexual content involving anyone under 18, non-consensual intimate imagery or deepfakes, hate speech or harassment, content intended to deceive or defraud, or malware. Do not attempt to jailbreak or circumvent our safeguards.
• Moderation — we may remove or restrict content, refuse or filter generated output, and suspend accounts that break these rules.
• Rights-holder complaints — if you believe output or uploaded material infringes your rights, email info.datemuse@gmail.com with enough detail to locate it. We will act on valid notices and may suspend repeat infringers.

You keep ownership of the photos, videos, custom places, notes and partner preferences you add. You grant us a limited license to host, store and display that material only to provide DateMuse to you and to anyone you deliberately share a date with — never to advertise, sell, or train AI models.

Uploaded media is stored privately and is not shown to other members unless you send them an invitation to a specific date. You can delete a photo, a video, or your whole account at any time, and we will remove the material from live storage.

Some suggestions are sample ideas we wrote ourselves to demonstrate the product; they are labeled as sample and may not describe a real, bookable venue. Other results come from third-party place data (Google) and are labeled as live. In both cases, venues are independent businesses: we do not control them, we are not party to any transaction between you and a venue, and details such as hours, prices, ratings and availability can change or be wrong. Check directly with the venue before you go.

We own everything we built: the software, the design, the brand, the date-idea library, and the curated routes. These Terms give you a personal, non-exclusive, non-transferable right to use the Service for your own date planning while your account is active. Nothing transfers ownership to you, and no other rights are granted.

We work to keep DateMuse available and reliable, but we do not guarantee uninterrupted or error-free operation. Features may change, and we may withdraw or limit parts of the Service. If we withdraw a feature you paid for and cannot replace it, we will apply our Refund Policy.

You can close your account at any time from your profile. We may suspend or end your access if you materially breach these terms, if payment is not made or is reversed as fraud, if your account presents a security or fraud risk, or for repeated or serious policy violations. Where we can, we will warn you first and explain why.

When your access ends, your date plans, saved places, photos and videos are deleted from live storage within 30 days, and you may ask us to export your saved plans first.

The Service is provided “as is”. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

If we are legally liable to you for anything arising out of these terms, that liability is limited to the total fees you paid us in the 12 months before the claim, and we are not liable for indirect, consequential or special losses such as lost profits, lost data or lost goodwill. Nothing here limits liability for fraud, death or personal injury caused by our negligence, or anything else that cannot lawfully be limited.

If a third party brings a claim against us because of content you uploaded, your unlawful use of the Service, or your breach of these terms, you will cover our reasonable costs and losses from that claim.

• Assignment — you may not transfer your account or these terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
• Force majeure — neither of us is liable for a delay caused by events reasonably outside our control.
• Severability — if a clause is unenforceable, the rest still stands.
• Entire agreement — these terms, together with our Privacy Notice and Refund Policy, are the whole agreement between us about DateMuse.
• Governing law — these terms are governed by the laws of the State of California, USA, and you agree to the exclusive jurisdiction of its courts, unless your local consumer law gives you a stronger protection you cannot give up.
